Acceptance
By creating an account, running a scan, or otherwise using misquoted.ai, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. These terms form a binding contract between you and misquoted, inc., a Delaware corporation.
You must be at least 18 years old and authorized to bind any organization on whose behalf you accept these terms.
Account & eligibility
You are responsible for keeping your authentication credentials secure. We use passkeys and TOTP — there is no password to share. You must notify us immediately at security@misquoted.ai if you suspect unauthorized access.
One account, one human. Sharing credentials is grounds for suspension. Sharing a workspace with teammates is encouraged; sharing a single login is not.
The service
misquoted.ai scans how a defined set of large language models describe a brand, scores the responses for accuracy and consensus, and produces reports. Scope of included scans, models, and features depends on the tier you've purchased. See the pricing page for current inclusions.
Subscription & billing
Paid plans are billed by Stripe in advance, either as one-time reports ($49 or $199) or as monthly subscriptions ($399 and up). Prices are in U.S. dollars and exclude taxes where applicable.
Renewals. Monthly subscriptions auto-renew unless cancelled. You'll receive an emailed receipt for every successful charge. Failed charges are retried per Stripe's standard schedule before the account is downgraded.
Cancellation & refunds
Cancel any time from your account settings. Cancellation takes effect at the end of the current billing cycle; access continues until then. One-time reports are non-refundable once the scan has begun. If a scan fails to deliver, contact support@misquoted.ai and we'll refund or re-run.
Customer data
You retain ownership of all data you submit. We process it only to provide the service, improve methodology in aggregate, and meet our legal obligations. We do not sell customer data and we do not train third-party AI models on it. See the privacy policy for details on retention, deletion, and your rights.
Intellectual property
The misquoted name, logo, methodology, scoring rubric, and software are owned by misquoted, inc. Reports we generate are licensed to you for unlimited internal use, sharing with auditors and clients, and reasonable external publication with attribution.
You may not resell our reports as your own product without a separate written agreement (see Agency).
Prohibited uses
You may not use misquoted to scan domains you do not have permission to research on behalf of, except for publicly available competitive analysis. You may not reverse-engineer the service, attempt to exfiltrate our methodology, or run automated scans outside the documented API.
Third-party models
We query OpenAI, Anthropic, Google, and Perplexity through their public APIs. We are bound by their terms of service for those queries. Model availability, response quality, and pricing are not under our control. Outages or methodology changes upstream may temporarily affect scan results.
Accuracy disclaimer
misquoted reports describe what AI models said about a brand at a specific moment in time. They are not legal advice, financial advice, or a substitute for primary-source research. Scores are estimates derived from a published methodology — useful, defensible, and intentionally conservative, but not infallible.
No warranty
The service is provided "as is" and "as available." We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI models will return the same answer twice.
Limitation of liability
To the maximum extent permitted by law, misquoted's aggregate liability is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars. We are not liable for indirect, consequential, incidental, or punitive damages.
Indemnification
You agree to indemnify and hold harmless misquoted, its officers, employees, and contractors from any claim arising out of your use of the service, your violation of these terms, or your violation of any third party's rights.
Termination
We may suspend or terminate accounts that violate these terms, with notice where practical. You may terminate at any time by cancelling and deleting your account. Upon termination, data is retained read-only for 90 days, then archived per the privacy policy.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware, and you consent to that jurisdiction.
Changes to these terms
We may update these terms periodically. Material changes will be announced by email and on the homepage at least fourteen days before they take effect. Continued use of the service after the effective date constitutes acceptance.
